There are several possible grounds for such an eviction action. One is that the tenant has failed to abide by some obligation in his lease or rental agreement with the landlord; for example, by creating a nuisance, damaging the premises, or keeping pets. Another is that the tenant has failed to pay the rent on time.

Under Senate Bill 611, tenants entering new lease agreements starting April 1, 2024 will no longer have to pay additional fees for their submitting rent payments or a security deposit by check. It also prohibits landlords from charging fees for certain notices, like lease termination.

California's Tenant Protection Act The Tenant Protection Act prohibits landlords from evicting most tenants without “just cause.” The law sets out two kinds of evictions: "at fault" evictions and "no fault" evictions. At fault evictions include: Nonpayment of rent. Breach of a material term of the lease.

Eviction is a legal process a landlord uses to make you move out. To evict you, your landlord must give you a 3, 30, 60 or 90-day notice. If you get one of these, it's important that you take action, like pay the rent you owe, move out, or get legal help.

California passed a new landlord-tenant law that will provide additional protections for renters around just cause evictions. The law took effect on April 1, 2024, and requires landlords to have just cause to terminate tenancy after a California tenant has been placed in the unit for 12 months.

Forcing a tenant out of a unit without a court order is not allowed in California. It is illegal for a landlord to do any of the following to try to force a tenant out of a unit: Remove exterior doors or windows. Prevent a tenant's access to the rental unit by changing the locks.

Section 48(1) of the RTA permits the landlord to give notice of termination to a tenant if the landlord, in good faith, requires the unit for residential occupation for a period of at least one year by the landlord, a specified family member or a caregiver. This notice is often referred to as a "N12 notice".

If they're doing something they aren't supposed to, you'll need to tell them what they're doing wrong. If your tenant won't fix the problem or move out, you'll have to go through the court to get an order for them to move out. The eviction process can take 30 - 45 days, or longer.
