Origins. The current state of prison labor in the United States has distinct roots in the slavery-era economy and society. The first for-profit prison, and prison to use forced, incarcerated labor, was created in New York State, with the construction of the Auburn Prison completed in 1817.

California allows a credit equal to 10% of the wages paid to each prisoner who is employed under an approved joint venture with the California Department of Corrections. The credit amount is based on wages paid to each qualifying employee during the taxable year for the duration of the contract agreement.

Summary: This Act provides for the employment of inmate labor in state correctional institutions and in the private manufacturing of certain products under specific conditions, and includes limitations on how prison industries may impact non-prison industries within the state.
