There are 3 types of Form 5500: Form 5500-EZ—for one-participant plans only; Form 5500-SF for plans with fewer than 100 participants; and Form 5500—for plans with 100 or more participants.

It's normally a year after it was due and includes a substantial penalty. Late filed returns are subject to penalties from both IRS and DOL, so it's very important to identify this mistake before we do. The IRS penalty for late filing of a 5500-series return is $25 per day, up to a maximum of $15,000.

One-participant plans that cover a business owner and a spouse, but no other employees, may require Form 5500-EZ. If the total plan assets are $250,000 or less, filing is not necessary. Those who do have to file Form 5500-EZ can do so either electronically or by mail.

Who must file form 5500-EZ? File a 5500-EZ if your Solo 401k had more than $250,000 in total assets during the previous calendar year or if last year was the final year of your plan. If you have less than $250,000 in plan assets, you don't need to file the 5500-EZ.

The plan administrator or employer (owner) must sign and date paper Form 5500-EZ for the 2021 filing. Section 6652(e) imposes a penalty of $250 a day (up to a maximum penalty of $150,000 per plan year) for not filing returns in connection with pension, profit-sharing, etc., plans by the required due date.

When a plan sponsor files a Form 5500 without the required audit report, the DOL sends the following: An inquiry email. Notice of Rejection ("NOR") letter – Plan sponsors have 45 days to come into compliance. If not, a proposed penalty letter is sent.
