Biologically no, one baby cannot have two different fathers. The baby after birth can have a legal father, and a biological father. If a man and woman are married at the time of the baby's birth, then he is considered to be in most states the legal father. However the baby can also have a biological father.

Presumption of paternity in paternity law and common law is the legal determination that a man is "presumed to be" a child's biological father without additional supportive evidence, usually as a result of marriage.

A person is presumed to be the father of a child in certain circumstances, including: The father is or has been married to the mother, and the child was born during the marriage, or within 300 days after the marriage was terminated by death, annulment, or divorce.

It is legally assumed that the married couple are the child's natural parents. But for unmarried parents, parentage of their children needs to be legally established by signing a declaration of parentage or obtaining a court order. Until these records are filed, the child officially does not have a legal father.

This may surprise you but not every adoption is permanent in California. Under certain circumstances, you can terminate an adoption by asking the court to reverse the adoption order. The process is referred to as a vacation or annulment. The child's natural parents or the adoptive parents can file a reversal petition.

Family Code Section 7611 defines presumed father: The parents were married and cohabiting at the time of conception. The parents signed a Voluntary Declaration of Parentage (see section above) or attempted to marry.

A presumed father/parent is a person whom the law presumes to be the legal father/parent of the child with all of the attendant rights and responsibilities.

In California, once a child is legally adopted, the biological parent's rights are generally terminated, and they cannot regain custody. Adoption is intended to create a permanent, legal relationship between the child and the adoptive parents, severing the legal ties to the biological parents.
