The business enterprise tax is imposed on the compensation, interest, and dividends paid by taxpayers engaged in business activities in New Hampshire.

The BPT rate is 8.5% of income for corporations with gross receipts over $50K. The BET rate is 0.75% on the enterprise value tax base (total compensation paid out, including dividends and interest). The BET is assessed on corporations with gross receipts over $150K or an enterprise value tax base over $75K.

Business Enterprise Tax & Business Profits Tax For taxable periods beginning on or after January 1, 2023, every business enterprise with more than $281,000 of gross receipts from all activities, or an enterprise value tax base of more than $281,000, must file a BET return. The filing threshold is adjusted biennially.

What is the Business Profits Tax (BPT)? A tax assessed on income from conducting business activity within the State of New Hampshire. For multi-state businesses, income is apportioned, using a weighted sales factor of two and the payroll and property factors.

The Voluntary Disclosure Program is designed to help resolve prior tax liabilities. The Department encourages businesses and individuals that are not in compliance with New Hampshire tax laws to voluntarily come forward to report and pay prior tax obligations.

The tax is assessed on the taxable business profits of business organizations conducting business activity within the state. The tax rate is 7.6% for taxable periods ending on or after December 31, 2022, and 7.5% for taxable periods ending on or after December 31, 2023.

How New Hampshire State Business Income Tax Works. New Hampshire has both a business profits tax (BPT), which is a tax on business income, and a business enterprise tax (BET), which is a tax on a business's enterprise value tax base. Both of these taxes apply to essentially every form of New Hampshire business.

The statute imposing the tax is found at RSA 78-B and NH Code of Administrative Rules, Rev 800. The tax is imposed on both the buyer and the seller at the rate of $. 75 per $100 of the price or consideration for the sale, granting, or transfer. What types of transactions are taxable?
