VA Form 21-4170 is used to gather information that is necessary to determine whether a valid common law marriage was established. The form is used by persons claiming to be common law widows/widowers of deceased veterans and by veterans and their claimed common law spouses.

The legal requirements for establishing a common law marriage vary from jurisdiction to jurisdiction. Per Burden v. Shinseki, the Department of Veterans Affairs (VA) must use the evidentiary standard of the state in which a common law marriage took place in order to determine the validity of a common law marriage.

To add a parent as a dependent, you must fill out VA Form 21-509, Statement of Dependency of Parent(s). To add a spouse from a common-law marriage as a dependent, you must fill out VA Form 21-686c, Declaration of Status of Dependents.

Virginia does not have common law marriage. No duties or obligations arise between two adults by living together in the same household unless such duties or obligation are set out by express agreement.

A: VA will recognize a common law marriage if the state in which the Veteran resides recognizes common law marriage, and the state's requirements for a common law marriage are met.

Unfortunately, your spouse cannot receive your VA disability compensation after you die. However, they may get a monthly allowance if they qualify for Dependency and Indemnity Compensation. If you lived in government housing, VA might also allow them to stay in residence for up to a year.

When to use this form. Use VA Form 21-10210 to submit a formal statement to support your VA claim—or the claim of another Veteran or eligible family member. People also sometimes call this statement a “buddy statement.”
