As of January 1, 2022, any retailer selling tobacco or vaping products in Oregon must have a license. Senate Bill 587 also removed tobacco purchase, use, and possession penalties for youth under the age of 18.

In August 2017, Oregon Governor Kate Brown signed Senate Bill 754, raising the legal age for buying tobacco products from 18 to 21 years. The law took effect Jan. 1, 2018.

Each tobacco retailer will have two inspections per year from the Oregon Health Authority. One inspection will make sure retailers are not selling to people under 21. The other will check for compliance with all tobacco retail sales laws.

Oregon law prohibits selling or distributing tobacco products, which includes devices that can be used to deliver tobacco, or inhalant delivery systems to individuals under the age of 21.

You must file an Oregon Unlicensed Tobacco Quarterly Tax Return, Form 531, for every quarter you purchase untaxed tobacco products. This can be done through Revenue Online by selecting “File a return" and choosing “File Form 531", or by using the form listed on our For​ms Page​.
