When this happens, the risk of wildfire is a serious concern. A burn ban means no outdoor burning is allowed, except in an enclosure that contains all flames and/or sparks. Non-commercial cooking, such as backyard cookouts and barbeques, are still allowed.

Interestingly, Texas law prohibits all outdoor burning, with the exception of that which is expressly allowed by the TCEQ regulation, or for which written permission from the TCEQ executive director is obtained (30 TAC §111.201).

The only burn permits allowed to be issued by the Texas Air Control Board must come through the Fire Marshal's Office. Only tree and brush trimmings are allowed to be burned and the material and area must be inspected by the Fire Marshal or his representative prior to issuance of a permit.

The Regulations: Burning only 1 hour after sunrise and not after I hour prior to sunset. Wind speed must be forecast to be greater than 6 mph and less than 23 mph. Post someone to flag traffic if smoke is expected to cross a road or highway. Don't start burning until inversion level has lifted.

Outdoor burning in general is prohibited in Texas, although the Outdoor Burning Rule (Appendix C) does allow certain exceptions. If your situation fits all requirements for one of the exceptions described in the rule, you may conduct outdoor burning, as long as you comply with all the condi- tions.

The following types of open fires are allowed in NYS. All fires must consist of only charcoal or dry, clean, untreated, and unpainted wood. Campfires, small cooking fires, or any other outdoor fire less than 3 feet in height and 4 feet in length, width, or diameter.
