'Neglect' means failure, refusal, or inability on the part of a caregiver, for reasons other than poverty, to provide necessary care, food, clothing, medical or dental care, or shelter so as to seriously endanger the physical health of the child.

Any person who thinks child abuse and/or neglect has happened or might happen can make a report to Child Protective Services (CPS) agency or law enforcement. By law, there are specified professional persons who are required to report child abuse or neglect.

A child welfare professional will write up your report. A supervisor will review the report and decide if the situation's seriousness is sufficient to merit assessment. If a decision is made to screen the case in, the supervisor will assign a time response based on the presenting information.

If no harm results to the child, child neglect is charged as a Class A misdemeanor, carrying up to 9 months in jail and up to $10,000 in fines.

In Wisconsin, Class A misdemeanor penalties include a fine not to exceed $10,000, imprisonment for up to 9 months, or both. (Wis. Stat. § 939.51) A Class A is the most severe misdemeanor, including charges like Bail Jumping.

Within 24 hours after receiving the report the agency or the county department shall initiate a diligent investigation to determine if the child is in need of protection or services. The determination of whether abuse has occurred shall be made within 60 days of receipt of the report.

During an investigation, a CPS worker will: Assess the safety of children in the home. Identify conditions in the home as well as behaviors and attitudes of parents and other family members that allow them to determine the risk of maltreatment.
