3 - A fundamental principle of death penalty law in the United States is that no person may be convicted of a capital crime except by the unanimous verdict of a 12-member jury. That is the law in all of the 38 states that have the death penalty, as well as in federal cases. There is, however, one exception.

In most states, a death sentence may only be imposed by a jury in unanimous agreement. But in two recent cases, defendants faced the possibility of a death sentence despite the objections of jurors.

This situation is a mistrial, sometimes referred to as a "hung jury," and may mean the case goes to trial again with a new jury.

The death penalty can only be imposed on defendants convicted of capital offenses – such as murder, treason, genocide, or the killing or kidnapping of a Congressman, the President, or a Supreme Court justice.

In a civil case, the judge will tell you how many jurors must agree in order to reach a verdict. In a criminal case, the unanimous agreement of all 12 jurors is required.

For criminal charges, both misdemeanors and felonies, California requires a unanimous 12 person jury to render a verdict of “guilty” or “not guilty.” If even just one of the 12 jurors disagrees with the other 11 after careful consideration of the evidence, this results in a hung jury.
