When the annuity holder passes away, the ownership and any annuity death benefits are typically transferred to the designated beneficiaries based on the contract language. The process is facilitated by the annuity company and generally involves submitting a death claim and required documentation.

The contract allows for a change of annuitant as many times as the owner wants, a death certificate is not required. A change of annuitant may be considered a taxable event and any gain may be taxable to the Owner.

It is possible for two people to jointly own an annuity. But because of tax code changes that occurred way back in 1986, there are no longer tax advantages to joint ownership.

If a non-qualified annuity is transferred to a spouse, it is not considered a taxable event. The annuity maintains its tax-deferred status, and the spouse will pay income taxes on the portion of each payment attributed to profits.

– You may change the owner, but only to the current owner's spouse. – You may only add a non-spouse joint owner if younger than you. You can do this only once, and you cannot change it. – You CANNOT change the owner or annuitant of a qualified annuity (funded with pretax money).

The annuitant is the person whose age and life expectancy is going to be used to calculate the benefits of the annuity and who will receive the annuity payments. Usually, the annuitant and the owner are the same person, but it is not required.

When you give an annuity away, you're changing the owner of the contract, but you're not changing the annuitant. Your life is still the life that will trigger benefits and determine the amount. The new owner of the annuity can start receiving payments, change beneficiaries, and cash out the policy whenever they want.
