Pursuant to CPLR §302(a), New York state courts can exercise personal jurisdiction over non-New York residents (also called non-domiciliaries) if such jurisdiction both aligns with the due process requirements established by the U.S. Constitution and the action is permissible under New York's long- arm statute itself.

The New York Civil Practice Law and Rules (CPLR) is chapter 8 of the Consolidated Laws of New York and governs legal procedure in the Unified Court System such as jurisdiction, venue, and pleadings, as well certain areas of substantive law such as the statute of limitations and joint and several liability.

Also called the best evidence rule. Permits the use of copies in court when those copies were prepared in the regular course of business by a process which accurately reproduces the original records and when those copies are satisfactorily identified. This use of copies is permitted whether the originals exist or not.

CPLR 205(a) is a well-known safety net in New York litigation, generally providing that a timely commenced action dismissed without prejudice can be refiled by “the plaintiff” within six months of dismissal, despite the statute of limitations expiring, saving the claim from being untimely.

Misdemeanors, regardless of the offense, are subject to a statute of limitations of two years in New York. Conversely, falsifying business records in the first degree is considered a Class E felony, which carries a statute of limitations of five years.

Business records exception is a statutory exception to the rule against hearsay in Federal and most state courts. The exception allows parties to enter regularly compiled records within an organization that meet a certain level of trustworthiness, and this exception often plays an important role in business litigation.

Generally business records can be identified as in fact being the records of a particular business through the testimony of the same witness whose testimony is used to show that the re- quirements of Rule 803(6) are met. See Rule 903(b)(1) (authentication by testimony of witness with knowl- edge).
