You own the property alone or jointly with another person; You, your current or former spouse, or common-law partner, or any of your children lived in (“ordinarily inhabited”) the property at some time during the year; and. You designate the property as your principal residence.

When you sell your home or when you are considered to have sold it, usually you do not have to pay tax on any gain from the sale because of the principal residence exemption. This is the case if the property was solely your principal residence for every year you owned it.

The seller must have owned the home and used it as their principal residence for two out of the last five years (up to the date of closing). The two years do not have to be consecutive to qualify. The seller must not have sold a home in the last two years and claimed the capital gains tax exclusion.

Indexation of the LCGE would resume in 2026. In practice, the lifetime capital gains exemption is provided in the form of a deduction when calculating an individual's taxable income. As of January 1, 2024, the maximum lifetime deduction is $508,418 (i.e., $1,016,836 x the current ½ inclusion rate).

To claim the capital gains exemption, first complete Schedule 3 to calculate your capital gains for the year. Then, transfer the amount from line 19900 of that schedule 3 to line 12700 of your income tax return(T1). If your capital gains qualify for the LCGE, use form T657 to calculate your deduction.

It must be a share sale of your business (sole proprietorships and partnerships do not qualify). More than 50% of the business's assets must have been used in an active business in Canada for 24 months prior to the sale.

The short answer is no. And this is because in Canada, when you sell your primary residence, you typically do not have to pay capital gains tax, due to the principal residence exemption. A capital gain happens whenever you sell property for more than you paid for it.

Generally, capital gains are not subject to non-resident withholding tax. However, where the property you dispose of is taxable Canadian property (TCP), Canadian non-resident withholding tax may apply. Examples of TCP include Canadian real estate, Canadian resource property and Canadian timber resource property.
