When you buy into a co-op, you invest in shares of a housing cooperative rather than own property. Co-ops are different from condos. They can be apartment buildings, duplexes, townhomes and other traditional residential structures – but they operate under different rules.

A Certificate of Occupancy (CO) states a legal use and/or type of permitted occupancy of a building. New buildings must have a CO, and existing buildings must have a current or amended CO when there is a change in use, egress or type of occupancy.

A TCO is the easiest to obtain, and the whole process takes about 6 months, or more, to complete.

In some circumstances the Department may determine a property is safe to occupy, but there are outstanding issues that must be resolved before a final CO can be issued. In this case, a Temporary Certificate of Occupancy (TCO) is issued.

If the developer fails to obtain the final CO or extend the TCO before it expires, occupying the building becomes a violation of the New York City Administrative Code (NYCAC) and any occupants may be subject to a vacate order.

The DOB issues two types of CO – a Temporary Certificate of Occupancy (TCO) and the final Certificate of Occupancy (CO). The TCO is usually valid for a maximum of 90 days, and is given when a building is accredited by the DOB, but hasn't gotten all the necessary building permits.
