The legislation requires condo associations to maintain reserve funds specifically allocated for structural repairs and maintenance. These funds must be determined based on reserve studies conducted every ten years, as outlined in SB-4D.

The Maryland Condominium Act was amended to increase from $5,000 to $10,000 the amount which a unit owner may be required to pay when the cause of fire, water or other casualty damage to units or the common elements originates in that owner's condominium unit.

(a) Unless the declaration or bylaws state otherwise, the dispute settlement mechanism provided by this section is applicable to complaints or demands formally arising on or after October 1, 2022.

As previously reported, during the 2022 legislative session, the Maryland General Assembly passed new legislation requiring all condominiums, homeowner associations, and housing cooperatives to undertake regular reserve studies of common area components. The Governor did not sign the bill, but it became law under Art.

Section 11-104 - Bylaws (a) The administration of every condominium shall be governed by bylaws which shall be recorded with the declaration. If the council of unit owners is incorporated, these bylaws shall be the bylaws of that corporation.

This new law clarifies the insurance requirements for condominiums with detached condominium units. Under the new law, condominium associations of such communities can choose whether to insure the entire condominium property or only to insure the common elements of the condominium.
