Overview. After their exchange, some J-1 visa holders must spend two years in their home country. This requirement is part of U.S. law, in the Immigration and Nationality Act, Section 212(e). If you cannot return home for two years, you must apply for a waiver.

Fulfilling Section 212(e) If you are subject to Section 212(e) and choose to fulfill it, you must be physically present in your country of nationality or last legal permanent residence for an aggregate of at least two years after departing the US at the end of your J-1 program.

The two-year home residency requirement (or 212(e), as it is referenced in the immigration regulations) means that those who come the U.S. in J-1 status cannot become permanent residents in the U.S., change status in the U.S., or get work or family-based visa status such as H, L or K until they return to their country ...

The 12 and 24 month rule affects J-1 exchange visitors who have been in the U.S. on a J-1 visa previously, and wish to return, using the J-1 visa. The bars prohibit certain “repeat participation” in the Research Scholar or Professor categories only.

30-Day Grace Period If you travel outside the U.S. during the grace period you will not be permitted to reenter the U.S. in J-1 or J-2 status. Employment and other exchange activities are prohibited during the 30-day grace period.

You are expected to work from your visa start date to your visa end date. If you quit your job or are fired from your job, you have 3 weeks in which to find a new job. If you decide not to find a new job, or if you are not able to find a new job within 3 weeks, the U.S. Government requires ERDT to cancel your program.

Exchange visitors may work in the United States if the work is part of the participants' approved program (for example, J-1 teachers, professors, summer camp counselors, summer work travel, au pairs) or when the official program sponsor approves their employment (for example, J-1 students).

Yes, you can! J-1 students are permitted to work while studying, as long as they obtain work authorization. There are certain restrictions, such as only working part time on campus for a maximum of 20 hours per week. Students are permitted to work full time during academic breaks.
