In Maryland, an uncontested divorce is one where you and your spouse agree on all the major elements of the divorce, meaning a judge won't need to decide any of these issues for you.

With all these factors in play, it can take anywhere from 90 days to two years for a judgment of absolute divorce to be granted in your case.

At an uncontested divorce hearing, only the defendant is required to attend. The plaintiff may be present if they so choose. Questions will be asked of the defendant by the judge who is presiding over the matter. If the divorce request is granted, the judge will sign the judgment of absolute divorce.

If you want to respond to a divorce case that your spouse has opened, use the Answer (CC-DR-050) and, if necessary, a Counter-Complaint for Absolute Divorce (CC-DR-094) or Limited Divorce (CC-DR-111).

Courts in Maryland can give one spouse the exclusive right to live in the family home for up to three years after the divorce. Under certain circumstances, the court might also award one side the exclusive use of personal property like household furniture and the family car.

DISTRICT COURTS In the Maryland district court, a defendant must respond to a complaint by filing a notice of intention to defend within 15 days after service of the complaint (Md. Rule 3-307). However, a defendant has 60 days to file the notice if the defendant is: ∎ Served outside of the state.

Once a Marital Separation Agreement has been reached, a Maryland divorce usually takes 30 to 120 days to become final. However, the length of time can vary depending on the specific court, caseload, and availability of judges.

Read the motion, and if you wish to, write a response to the motion. You must send the other parties a copy of your response, and file your response with the court. After being served with a motion, you must file your response with the court within the set time limit, usually 15 days.
