Examples of education records include: academic evaluations, including student examination papers, transcripts, test scores and other academic records; general counseling and advising records; disciplinary records; and financial aid records, including student loan collection records.

FERPA gives students the following rights regarding educational records: The right to access education records kept by the school. The right to amend education records. The right to request that education records be disclosed only with student consent.

The Family Educational Rights and Privacy Act of 1974 (FERPA) protects the privacy of students by limiting third party access to student education records. When a student reaches the age of 18 or begins attending a postsecondary institution, regardless of age, FERPA rights transfer from the parent to the student.

The term "education records" does not include the following: Records relating to individuals who are employed by the institution, which are made and maintained in the normal course of business, relate exclusively to the individuals in their capacity as employees, and are not available for use for any other purpose.

It encompasses paper and electronic files, grades, video recordings, audio recordings, and other data. The personal knowledge and observations of educators that are not part of the record are not covered by FERPA. FERPA applies to currently-enrolled students.

Who can access my student's education data? In general, education data are classified as private under Minnesota state law. Federal law also generally protects the privacy rights of parents and students. Under these state and federal laws only parents, students, and school officials may access education data.

FERPA, a federal law, gives parents and eligible students (18+) control over their records. Common FERPA violations include sharing information without consent, not implementing proper security measures, and not informing parents of their FERPA rights.

Anyone may request public records and they are also entitled to have the data explained to them if they don't understand it. No statement of purpose is required and the only restriction of the use of records is that if a commercial use is intended the government agency may charge an additional fee.

FERPA requires that schools cannot disclose private data or personally identifiable information from a student's education record without consent or an eligible exception.

Records which are kept in the sole possession of the maker of the records, are used only as a personal memory aid, and are not accessible or revealed to any other person except a temporary substitute for the maker of the records.
