The IRS doesn't recognize registered domestic partnerships (RDPs) as marriages. Because of this, RDPs must file their federal and California tax returns using two separate accounts. If this applies to you, RDP couples must file a federal return as Single or Head of Household.

Under this State law, for purposes of California income taxes, employees who purchase medical and dental coverage for a registered domestic partner and the domestic partner's dependents may pay for the employee portion of the applicable premiums on a before-tax basis.

To qualify as a dependent, your partner must receive more than half of his or her support from you. If your partner is a dependent, you might also be eligible for other favorable tax treatment. If you think that your partner might be your dependent under federal law, consult a tax professional.

Conditions to Claim an Unmarried Partner as a Dependent The domestic partner must have lived with the taxpayer for the entire tax year in a domestic partnership that is recognized by the state or local government where they reside.

You can claim a boyfriend or girlfriend as a dependent on your federal income taxes if that person meets certain Internal Revenue Service requirements. To qualify as a dependent, your partner must have lived with you for the entire calendar year and listed your home as their official residence for the full year.

The domestic partnership is a legal relationship between two people of the same or opposite sex who live together and share a domestic life, but are not married or joined by a civil union nor are blood relatives.

A dependent waiver is required when an applicant is married with more than two dependents under the age of 18 or when an applicant is unmarried and has custody of any dependents under the age of 18.

You must live together. To qualify as a dependent, your significant other must have lived with you for at least one calendar year. If you lived together for a shorter time, you cannot claim your significant other as a dependent.
