Texas does not have a state law making it mandatory for private sector employers to provide paid or unpaid sick leave. Public sector employers, however, must give their employees sick leave at the rate of eight hours per one month of employment for full-time employees.

Sick Leave Pool – An employee becomes eligible to withdraw time from the sick leave pool if the employee has exhausted his or her sick leave because of a catastrophic illness or injury of the employee or of a member of the employee's immediate family (see the definition of “immediate family”).

Eligibility for Sick Leave Sick leave is available to UT System employees who are scheduled to work a minimum of 20 hours per week for at least 4.5 continuous months in a position that does not require student status as a condition of employment.

No current Texas or federal law requires private-sector employers to provide paid or unpaid leave of any kind, although some amount of unpaid leave may be necessary as a reasonable accommodation in the event of a disability, pregnancy, or other condition protected under a specific statute.

If an employee wishes to take more than three days of paid sick leave, they must provide a doctor's certificate stating the reason for their absence. Duration: Full-time employees can accrue up to 8 hours of sick leave for each month of employment, while part-time employees accrue sick leave on a proportionate basis.

How paid sick and carer's leave accumulates. Full-time and part-time employees accumulate sick and carer's leave during each year of employment. It starts accumulating from an employee's first day of work and is based on their ordinary hours of work. The balance at the end of each year carries over to the next year. If an employer provides you with your sick leave as you earn it, for example, you earn one hour for every 30 hours worked, then any unused leave from one year must carry over into another year, where it must be used.

How Much Leave Is Available? Employees in Texas may take up to 12 weeks of leave in a 12-month period for a serious health condition, bonding with a new child, or qualifying exigencies. This leave renews every 12 months, as long as the employee continues to meet the eligibility requirements set out above.
