The care of adult patients without decision-making abilities is a routine part of medical practice. SDMC uses volunteers to review declarations regarding a person's capacity and need for treatment and then renders a decision at a quasi-judicial hearing. These volunteers serve on panels throughout New York State. Every panel must have a New York State licensed attorney as one of its members.

Adults. In most states, the default surrogate decision maker for adults is normally the next of kin, specified in a priority order by state statute, typically starting with the person's spouse or domestic partner, then an adult child, a parent, a sibling, and then possibly other relatives.

A surrogate decisions maker, also known as medical or healthcare proxies, is defined as a legally designated representative trusted with making medical decisions on a person's behalf when they are unable to make decisions for themselves.

If the patient has a health care proxy, the health care agent named in the proxy makes decisions. If a patient does not have a health care proxy, a legal guardian (or the person highest in priority from the surrogate list, known as “the surrogate”) makes decisions.
