Is the non custodial parent responsible for health insurance in California? In California, a noncustodial parent can be ordered by the court to pay for medical and dental insurance as part of child support obligations.

Noncustodial parents generally retain the same rights as custodial parents unless a court order restricts the rights of the noncustodial parent. These rights include but are not limited to accessing his/her child's student records, participating in school activities and visiting the child at school.

If cash medical support is ordered, it is due in addition to basic child support. Generally speaking, the court will order the expenses not covered by insurance to be shared by the parents based on a- 50-50 split; 50% to each parent.

Notwithstanding any other provision of law, access to records and information pertaining to a minor child, including, but not limited to, medical, dental, and school records, shall not be denied to a parent because that parent is not the child's custodial parent.

California child support laws Family Code Section 4063 mandates that the parent who is being reimbursed for expenses must give the other parent an a list of the out of pocket expenses that they have incurred within a reasonable time, but not more than 30 days after the expenses have been paid.

This means the cost for the health insurance is used as a factor in determining the final support figures, and reduces the total amount of child support to be paid. Let's assume that neither parent has health coverage. What does this mean for the child?
