EB-1A extraordinary ability examples for a one-time achievement include receiving an Oscar, a Nobel Prize, an Olympic medal, or an award of equivalent nature.

EB-3 Skilled Worker is for jobs that require at least 2 years of experience, education, or training. Training can include relevant post-secondary education. Other Worker is for jobs that are considered unskilled labor, requiring less than 2 years of training or experience.

To qualify as an individual of extraordinary ability, an individual must show evidence of receipt of a major internationally recognized award, such as the Nobel Prize, or satisfy at least three of the following: Receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field.

INA § 203(b)(2); 8 C.F.R. § 204.5 (k). There are two sub-categories under the EB-2 preference category: (1) Members of the professions holding advanced degrees; and (2) Foreign citizens possessing exceptional ability in the sciences, arts, or business.

Section 203(b)(2) of the Immigration and Nationality Act ("INA") permits the issuance of immigrant visas to foreign nationals with advanced degrees or those with exceptional ability.

INA § 203 (8 USC § 1153)- Allocation of immigrant visas. (a) Preference allocation for family-sponsored immigrants. Aliens subject to the worldwide level specified in section 1151(c) of this title for family-sponsored immigrants shall be allotted visas as follows: (1) Unmarried sons and daughters of citizens.

Section 203(b)(2) of the Immigration and Nationality Act ("INA") permits the issuance of immigrant visas to foreign nationals with advanced degrees or those with exceptional ability.

Section 203(b)(1)(A) covers aliens of extraordinary ability in the sciences, arts, education, business, or athletics. Section 203(b)(1)(B) covers outstanding professors and researchers. Section 203(b)(1)(C) covers certain multinational executives and managers coming to work for a qualifying firm in the United States.
