Final Payments Whenever an employer discharges an employee, employers in New Hampshire must pay an employee's last paycheck to them within 72 hours of termination. Whenever an employee quits or resigns, the employer shall pay the employee's wages no later than the next regular payday. N.H. RSA § 275:44.

Generally, under N. H. Rev. Stat. Ann. § 275:44, an employer must issue a final paycheck to a terminated employee within seventy-two (72) hours.

Payment of Accrued, Unused Vacation on Termination Employers must only follow their policies. Whether earned but unused vacation time is paid upon separation from employment is determined by the employer's policy or the employee's contract.

A salaried employee in New Hampshire can work up to 40 hours in a standard workweek. If a salaried employee's work hours exceed 40, they are eligible for overtime compensation at 1.5 times their hourly rate.

Employers must allow their employees to have at least 24 consecutive hours off from work in every seven-day period.

California, in fact, has some of the strictest laws in this regard. In this state, an employee who is fired or laid off is entitled to a final paycheck right away, at the time of the termination. If an employee quits, however, the employer is required to provide the final paycheck within 72 hours.

Under New Hampshire Meal Break Law, employees who work more than five consecutive hours must be provided with a lunch break or meal period of 30 minutes. A meal break need not be given if the employee is able to eat while performing their duties, AND the employer permits them to do so.

Pay Requirements in New Hampshire Payment of wages must be made within eight days of the end of the pay period. Employees who are not paid within this time frame are entitled to claim their unpaid wages, plus liquidated damages, under New Hampshire law.
