Federal law places limits on how much judgment creditors can take. The garnishment amount is limited to 25% of your disposable earnings for that week (what's left after mandatory deductions) or the amount by which your disposable earnings for that week exceed 30 times the federal minimum hourly wage, whichever is less.

The CRA is allowed to garnish up to 50% of a payroll employee's salary but typically it is more often done at around 30%. They can garnish up to 100% of a self-employed individual's salary but this is highly unlikely and often a lower number is reached.

If the debtor either cannot or will not pay the debt, the creditor has several possible courses of action to attempt to enforce their judgment. The creditor may choose either to garnishee the debtor's wages or bank account or to seize some of the debtor's goods under an execution order.

Getting a Certificate of Default Judgment is not the end of the Court process. If the Defendant does not voluntarily pay you the amount awarded in the Judgment, you must then take steps to enforce (collect) the Judgment. The Court does not collect the money for you.

The following income streams are exempt from wage garnishment orders: Canada Pension Plan, Old Age Security, Guaranteed Income Supplement, and Employment income. Union membership dues. Basic financial assistance (such as welfare payments)

If your employee owes CRA a sum of money and refuses to pay it, it is possible that CRA may garnishee that employee's wages. In such a case, the CRA will send you a requirement to pay notice for you to send the amount owed to the CRA instead of giving it to the employee.

In ance with the Ontario Wages Act, the maximum that your creditors can garnish from your wages is 50%. Commercial debts such as credit cards and bank loans can only garnish a maximum of 20% of your wages. If you owe arrears to the Family Responsibility Office they can garnish up to 50% of your wages.
