A form of privilege that protects confidential communications between an attorney and a client that are made for the purpose of obtaining or providing legal advice from disclosure to third parties. For example, the attorney-client privilege protects the: Client's request for legal advice from a lawyer.

The attorney-client privilege protects confidential communications made during an attorney client relationship from disclosure. Cal. Ev. Code § 954.

You can freely admit to your lawyer that you committed a crime, and the attorney-client privilege will protect that conversation. But if your conversations with your attorney are for planning or furthering an ongoing crime or fraud, or one that hasn't happened yet, the attorney-client privilege doesn't apply.

The privilege extends only to communications that the client intends to be confidential. Communications made in non-private settings, or in the presence of third persons unnecessary to accomplish the purpose for which the attorney was consulted, are not confidential and are not protected by the privilege.

Very simply put, attorney-client privilege stems from rules of EVIDENCE, whereas confidentiality stems from rules of ETHICS. But that's not all. Starting with confidentiality, every state has Rules of Professional Conduct that apply to lawyers who are licensed in that state.

CRIME/FRAUD EXCEPTION: Pursuant to §90.502(4)(a), there is no attorney-client privilege when the services of the lawyer were sought or obtained to enable or aid anyone to commit or plan to commit what the client knew was a crime or fraud.

Attorney-client privilege is waived when the protected person shares the information with a third-party. For instance, let's say you told your lawyer something that you expected would be privileged. Then, you told your spouse, and that, too, is privileged. But then you told your best friend and your mom.
