Under the Federal Rules of Procedure, an answer to a counterclaim or cross-claim is due twenty-one (21) days after service of the pleading that asserts the counterclaim or cross-claim. Fed. R. Civ.

Counter claim means a claim made by the defendant in a suit against the plaintiff. its a claim independent of and separable from the claim of the plaintiff. It's is cause of action against the plaintiff but in favour of the defendant. It's is treated as plaint of the defendant against the plaintiff.

INSTRUCTIONS: 1) Complete the form(s) 2) Make copies of the answer form and counterclaim form. The court will require an original of each and you may wish to have copies; additionally each named plaintiff will need a copy. 3) File papers with the court clerk 4) There is no fee for the counterclaim.

A counterclaim must be filed within 20 days of service of the summons, complaint, and Notice to Plaintiff and Defendant. The amount of the counterclaim cannot be more than $3,500. If the counterclaim exceeds $3,500, the court must transfer the case to the civil division of the justice court.

A Defendant has the Burden of Proof on Counterclaims. This means that the Defendant must be prepared to develop the Counterclaims and present supporting evidence to the Court. Many traditional civil claim require a party must prove the claim by a “preponderance of the evidence”.

Both Rule 95 and Order VIII Rule 6-A specify an outer limit beyond which no Counter-Claim can be filed. In other words, it is not open to a defendant to file a Counter-Claim at any time that defendant chooses. It must be filed along with the defence or before the time limited for filing the defence has expired.

Counterclaim. The defendant may file a counterclaim, which asserts that the plaintiff has injured the defendant in some way, and should pay damages.

The counterclaim is made to offset the liability against the claim of the claimant or an independent claim of a person with related interests or obligations.
