A motion for summary judgment is a motion asking the court to issue summary judgment on at least one claim. If the motion is granted, a decision is made on the claims involved without holding a trial.

While a motion to dismiss focuses on allegations, a motion for summary judgment is all about evidence. While a motion for summary judgment can be filed earlier, most often it is filed after the conclusion of discovery (when the parties produce and exchange documents, take depositions, and develop other evidence).

Briefly describe the relevant undisputed facts of the case. Describe why summary judgment should be granted. I look for opportunities here to grab the judge's attention by telling him or her that I am dropping one of my arguments, and stating why. This lets the judge know I am not going to waste the court's time.

If a court grants a motion for summary judgment, it means that it will rule on the issues as a matter of law and grant judgment in favor of one of the parties. If a party wins a motion for summary judgment, it means that party did not like the facts found by the court and may appeal based on errors of law.

So, what happens after a partial summary judgement is granted? Since the case is not yet complete, it will eventually proceed to trial.

Although the law is clear that only admissible evidence may be considered on summary judgment, that does not mean that the material must be presented in a form that would be admissible at trial. Affidavits and declarations are the classic examples.
