FOUO information should be handled in a manner that provides assurance that unauthorized persons do not gain access. During working hours, reasonable steps should be taken to minimize risk of access by unauthorized personnel.

The Government will mark all UCI information/material as 'FOR OFFICIAL USE ONLY” (FOUO). This category identifies information that is exempt from mandatory release under the provision of the Freedom of Information Act (FOIA). FOUO is not a security classification, it is protective marking /caveat.

CUI or FOUO information should be handled in a manner that provides reasonable assurance that unauthorized persons do not gain access. Direct quotes from CUI or FOUO documents should not be used in publicly accessible reports, theses etc. as this may constitute release of restricted information to unauthorized persons.

FOUO information may be transmitted over official email channels but cannot be sent to personal email accounts. For added security, when transmitting FOUO information by email, password protected attachments should be used with the password transmitted or otherwise communicated separately.

It is to be controlled, stored, handled, transmitted, distributed, and disposed of in ance with DHS policy relating to FOUO information and is not to be released to the public or other personnel who do not have a valid "need-to-know" without prior approval of an authorized DHS official.

Controlled Unclassified Information (CUI) is information that requires safeguarding or dissemination controls consistent with applicable laws, regulations, and Government-wide policies, but is not classified under Executive Order 13526 “Classified National Security Information” or the Atomic Energy Act, as amended .

DoD Directive 5400.7 defines For Official Use Only information as "unclassified information that may be exempt from mandatory release to the public under the Freedom of Information Act (FOIA)." The policy is implemented by DoD Regulation 5400.7-R and 5200.1-R.

FOUO and CUI may include personnel information, payroll information, and sensitive information, but they do not include secret information. Secret information is classified information that requires a higher level of protection and clearance than FOUO or CUI.

CUI is not a classification. Therefore, information cannot be “classified as CUI;” rather, this type of information is designated as CUI. In some cases, CUI designations replace For Official Use Only (FOUO) and Sensitive but Unclassified (SBU) designations and markings.
