The minimum set-aside election for a project is made by the owner after the first year of the credit period on IRS Form 8609 line 10(c).

Section 42(a) provides for a credit for investment in certain low-income housing buildings. The amount of the low-income housing credit for any taxable year in the credit period is an amount equal to the applicable percentage of the qualified basis of each qualified low-income building (as defined in § 42(c)(2)).

Purpose of Form. Use Form 8586 to claim the low-income housing credit. This general business credit is allowed for each new qualified low-income building placed in service after 1986. Generally, it is taken over a 10-year credit period.

Eligible small businesses use Form 8826 to claim the disabled access credit. This credit is part of the general business credit.
