The Uniformed Services Employment and Reemployment Rights Act (USERRA) is a federal law, passed in 1994, that protects military service members and veterans from employment discrimination on the basis of their service, and allows them to regain their civilian jobs following a period of uniformed service.
-
USERRA protects members of the uniformed services during employment. Employers cannot take military service into account when they fire, discipline, promote, or award benefits to employees.
-
Can an employer discriminate based on past or present military service? No. An employer must not deny initial employment, reemployment, retention in employment, promotion, or any benefit of employment to an individual on the basis of his or her military service.
-
Many employment applications touch on an applicant's affiliation with the military. While answering the question is not necessarily required and can be left blank, not disclosing any affiliation could potentially result in legal employment termination if the military affiliation conflicts with employment requirements.
-
Employers must make reasonable efforts to qualify a returning service member for the reemployment position. Employers must provide refresher training, and any other training necessary to update a returning employee's skills so that he or she has the ability to perform the essential tasks of the position.
-
Many employment applications touch on an applicant's affiliation with the military. While answering the question is not necessarily required and can be left blank, not disclosing any affiliation could potentially result in legal employment termination if the military affiliation conflicts with employment requirements.
-
Under USERRA your employer cannot discriminate against you as a current military employee, veteran, or applicant for membership in the uniformed services. This applies to all aspects of employment, including, hiring, work duties, promotions, benefits, and firing.
-
If there is a legitimate business reason for the layoff and for the selection of the employee on military leave, an employer may be permitted to lay off an employee who is on a military leave of absence under the Uniformed Services Employment and Reemployment Rights Act (USERRA).
