What is Form 8832? Form 8832 is the IRS form a new Limited Liability Company (LLC) uses to elect how it wants to be taxed or an established LLC uses to change its current tax classification. Most often, the form is used by a newly formed LLC that wants to be taxed as a C-corporation.

Once an incorrect accounting method has been used for two years, a Form 3115 is required to change accounting methods back to a correct method, or in this case, since not taking depreciation is incorrect, to begin taking depreciation a Change in Method Form 3115 must be filed.

Use Form 8832, Entity Classification Election to make an election to be an association taxable as a corporation. Use Form 2553, Election by Small Business Corporation to make an election to be an S corporation. If a taxpayer doesn't file Form 2553, the default classification will apply.
