An Indiana general warranty deed is a type of deed with which a seller provides a warranty or guarantee that the property he or she is selling is free from other claims. In other words, the deed guarantees that if someone else claims ownership of all or part of the property, the seller will defend the buyer.

The way a quitclaim deed works is that this type of transfer makes no seller guarantees. It merely states that the seller transfers any ownership interest to the buyer. So if the seller has absolutely no ownership interest in the property, that's precisely what transfers in a quitclaim deed to any buyer.

A warranty of title is a legal guarantee from the transferor to the transferee that there are no title issues. If a deed makes a warranty of title, the transferee can sue the transferor over any title issues.

Under a warranty deed, the transferor guarantees that the real estate is “free from all encumbrances and that he will warrant and defend the title to the same against all lawful claims.” IND. CODE 32–1–2–12.1 The existence of a highway easement constitutes a breach of a covenant against encumbrances.

A quit claim deed form must include the following information: the names of the grantor (the person transferring the property) and the grantee (the person receiving the property), the legal description of the property being transferred, and the date the transfer is taking effect.
