A. All property acquired by either husband or wife during the marriage is the community property of the husband and wife except for property that is: 1. Acquired by gift, devise or descent.

Arizona law defines separate property as property that is acquired prior to marriage, or received as a gift from a third party, or received by inheritance. This also includes gains on such property (such as rent, interest, etc.).

The general concept of a community property system is that all assets acquired by a married couple during the marriage are presumed to be owned equally upon divorce. Of course, this is subject to many exceptions and nuances.

Arizona law defines separate property as property that is acquired prior to marriage, or received as a gift from a third party, or received by inheritance. This also includes gains on such property (such as rent, interest, etc.).

Under Arizona's community property law, a spouse may not force their other spouse to vacate a marital home acquired by either spouse or both spouses during the marriage. As community property, the house belongs to both spouses.

(ARS § 25-211). A party challenging that presumption has the burden of rebutting (overcoming) the presumption. The presumption of community property, can, in part, be overcome if the challenging party can prove by clear and convincing evidence that the property at issue was acquired as a gift.

Property acquired before marriage by one spouse is presumed to be the separate property of that spouse. On the other hand, property received during marriage is presumed to be community property of both spouses, unless it was acquired by gift, devise or descent (an inheritance) by one spouse.
