The New Jersey Open Public Records Act requires a response time of seven business days. If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.

The deliberative process privilege was established to protect internal opinions and recommendations involving agency policies. While this privilege applies in some circumstances, it may be overcome if the interest of disclosure outweighs the governmental interest in maintaining the confidentiality of information.

Submit a written OPRA request, complete the Government Records Request Form and submit it by mailing the form to the appropriate division/department as directed on the second page of the form.

Under OPRA, the custodian must respond to request "as soon as possible," but requesters must receive a response within seven business days after the custodian receives a complete request. That does not mean that a record in storage, or one that is difficult to find, will be available during that time.

OPRA is a state law that was enacted to give the public greater access to government records maintained by public agencies in New Jersey. Government records available from Legislative offices are primarily Legislative records.

Within 45 days after the denial, you can file a lawsuit in NJ superior court. You pay a $250 filing fee, mailing & copying costs, and other applicable court fees.
