The Montana statute of limitations on enforcement of child support is 10 years from the date of payment due for debt accrued prior to 10/1/1993; 10 years after termination of obligation for payments due after 10/1/1993.

The state of Montana finds a non-payment of child support payments burdensome. As a result, the state vigorously enforces payment through the Child Support Enforcement Division (CSED), of the Montana Department of Public Health and Human Services.

The CSSD is required to develop and distribute child support guidelines to determine child support obligations. The Montana guidelines are based on a formula in which the income of both parents are considered. The guidelines must consider certain factors as set out in, MCA 40-4-204(2) and 40-6-116(5) .
