(2) For a partnership that has made an election under Section 1 of this act to be taxed as an electing pass-through entity, the partnership shall pay income tax as provided for in Section 1 of this act. (c) On all taxable income in excess of Ten Thousand Dollars ($10,000.00), the rate shall be five percent (5%).

Pass-through income is only subject to a single layer of income tax and is generally taxed as ordinary income up to the maximum 37 percent rate. However, certain pass-through income is eligible for a 20 percent deduction, which reduces the top tax rate to a maximum of 29.6 percent.

All Mississippi LLCs are taxed as a pass-through entity by default, which means all of the business' revenue is reported on the members' individual tax returns. In addition to the federal 15.3% self-employment tax, Mississippi LLC members pay the Mississippi personal income tax rate, which starts at 4%.

Every partnership, domestic or foreign, deriving income from property owned within the state of Mississippi, or business, trade, profession or occupation, carried on within the state shall make a return for each taxable year.
