What is Form 1040-NR used for?

Form 1040-NR is the primary form used by nonresident aliens for filing a U.S. tax return. A taxpayer is considered a U.S. nonresident if they do not have a green card or do not satisfy the substantial presence test.

Resident & Non-resident. If you file form 1040 (U.S. resident return), you must report, and are subject to taxation on your worldwide income. Non-Residents, who file form 1040NR, must only report their US sourced income.

Schedule NEC - Tax on Income Not Effectively Connected With a U.S. Trade or Business. Schedule NEC (Form 1040-NR) is used to report income not effectively connected with a U.S. trade or business. This may include, but is not limited to, dividends, royalties, and gambling winnings.

If you file Form 1040-NR, use Schedule NEC (Form 1040-NR) to figure your tax on income that is not effectively connected with a U.S. trade or business and to figure your capital gains and losses from sales or exchanges of property that is not effectively connected with a U.S. business.
