7309 establishes a Board of Claims to compensate victims of unjust imprisonment or detention and victims of violent crimes, providing a clear process for filing claims and setting a maximum limit for compensation awards. The Board of Claims is responsible for reviewing and evaluating claims to ensure timely resolution.

The federal standard to compensate those who are wrongfully convicted is a minimum of $50,000 per year of incarceration, plus an additional amount for each year spent on death row. Those proven to have been wrongfully convicted through post-conviction DNA testing spend, on average, more than 14 years behind bars.

– For victims of unjust imprisonment or detention, the compensation shall be based on the number of months of imprisonment or detention and every fraction thereof shall be considered one month; Provided, however, That in no case shall such compensation exceed One Thousand pesos (P1,000.00) per month.
