Grantor trust rules are guidelines within the Internal Revenue Code (IRC) that outline certain tax implications of a grantor trust. Under these rules, the individual who creates a grantor trust is recognized as the owner of the assets and property held within the trust for income and estate tax purposes.

Under the grantor trust rules of IRC §§671 through 679 a grantor is taxed on his or her share of a trust's income if certain powers over, or rights in, the trust are retained. This is also the case if the rights or powers are held by nonadverse parties, or by related or subordinate parties.

Income is reported on an attachment to the Form 1041, which also identifies the grantor as the owner of trust income.
