Every withholding agent or intermediary who receives, controls, has custody of, disposes of, or pays a withholdable payment (to which chapter 4 withholding applies) or an amount subject to withholding, must file an annual return for the preceding calendar year on Form 1042 unless an exception to filing applies.

File Form 1042-T (and Copy A of the paper Forms 1042-S being transmitted) with the Ogden Service Center, P.O. Box 409101, Ogden, UT 84409, by March 15, 2024. Send the forms in a flat mailing (not folded).

Forms 1042, 1042-S and 1042-T are United States Internal Revenue Service tax forms dealing with payments to foreign persons, including nonresident aliens, foreign partnerships, foreign corporations, foreign estates, and foreign trusts.

A taxpayer can choose to file Tax Year 2022 Form 1042 electronically. If a taxpayer prefers to file electronically but needs additional time to become familiar with the XML schemas , consider requesting an extension to file Form 1042.

Every withholding agent must file an information return, Form 1042-S, Foreign Person's U.S. Source Income Subject to Withholding, to report amounts paid to foreign persons that are described under Amounts Subject to NRA Withholding and Reporting, even if withholding is not required on the payments.

Form 1042-T, also "Annual Summary and Transmittal of Forms 1042-S", is used to transmit Form 1042-S to the Internal Revenue Service. Form 1042-T is simply a 1-page summary of Form 1042-S. This form (along with Form 1042-S) is submitted to the IRS only, not to the non-resident alien.

A 1042-S is a year-end federal tax document given to a non-resident alien who: Received wages exempted from federal and state tax withholding by a tax treaty; and/or. Received a non-qualified taxable scholarship (Any amounts received for incidental expenses or by a non-degree candidate are taxable scholarships.
