Code Rule 59 It requires a comprehensive safety and loss prevention consultation and evaluation for an employer with: An annual payroll of over $800,000. A workers' compensation experience modification rating of more than 1.20.

Workers' Compensation coverage is not required if the business is a one or two person owned corporation, with those individuals owning all of the stock and holding all offices of the corporation (each individual must hold an office and own at least one share of stock).

INDUSTRIAL CODE RULE 60: WORKPLACE SAFETY AND LOSS INCENTIVE PROGRAM. Unlike Code Rule 59, which is mandatory for certain NY employers, Code Rule 60 is a voluntary program that offers employers insurance premium credits.

Workers' Compensation Coverage Sole Proprietorships Workers' compensation coverage is not required for a sole proprietor who does not have employees. However, a sole proprietor may voluntarily cover themselves under a workers' compensation policy.

New York Employer's Liability is a business insurance coverage included with a Workers' Compensation policy. This coverage is designed to shield the business against legal liability arising from employee death or injury. This coverage includes employees, family members, and any third party who might seek legal action.

The Public Employee Safety and Health Bureau (PESH), created in 1980, enforces safety and health standards promulgated under the United States Occupational Safety and Health Act (OSHA) and several state standards.

Employers must have a workers' compensation insurance policy. It can come from a private insurance carrier, the New York State Insurance Fund, or self-insurance. Businesses must show proof of the policy when getting business permits. Businesses may be exempt in very narrow circumstances.
