Hospitals and medical offices may try to require nurses to work overtime instead of properly staffing the hospital. California law prohibits mandatory overtime for nurses except in “emergency situations” (such as a natural disaster).

It refers to the situation where employers require their employees to work hours beyond their regular schedule, often due to staffing shortages, unforeseen emergencies, or increased demand for services.

Mandatory overtime: Illegal (Department of Industrial Relations, Wage Order 4-2001 Section 11040), with exceptions for emergencies. However, nurses may not be forced to work more than 72 hours in a week. Maximum legal shift: 12-hour shift.

Now New York State has joined 14 other states in strongly restricting mandatory overtime for RNs. The law prohibits hospitals from requiring nurses to work beyond our scheduled shifts – except in the case of a declared emergency. And the law protects us from retribution or discipline for refusing overtime.

Q. Can an employer require an employee to work overtime? A. Yes, in general an employer may dictate the employee's work schedule and hours.

Generally, an employer cannot force a nurse to work overtime or punish a nurse for refusing overtime work. However, emergencies are an exception to that rule. Hospitals can require nurses to work up to 72 hours a week in emergencies, such as a natural disaster, terrorist attack, or other declared emergency.

Currently, 18 states have enacted laws or regulations applicable to nurses that either prohibit or limit mandatory overtime for nurses: Alaska, California, Connecticut, Illinois, Maine, Maryland, Massachusetts, Minnesota, Missouri, New Hampshire, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Texas, ...
