Frequently Asked Questions about CA Form 199 Form 199 is an annual information return filed by tax-exempt organizations and certain other nonprofits to report their financial information and activities to the Franchise Tax Board (FTB) as part of their tax filing requirements.

Organizations granted tax-exempt status by the FTB (Franchise Tax Board).. Nonexempt charitable trusts as described in IRC Section 4947(a)(1). *However an Organization can file Form 199 voluntarily. FTB 199N must be filed electronically.

This form must be filed on or before the 15th day of the fifth month after the close of your organization's fiscal year (for example, if the year ends December 31, the form is due no later than May 15). Private foundations are required to file Form 199 regardless of the gross receipts amount.

Payment of Filing Fee. Beginning January 1, 2021, exempt organizations are no longer required to pay the $10 annual information return filing fee for form FTB 199.

Filing Fees: The $10 filing fee and the $25 late return filing fee are no longer required for Form 199 due on or after 01/01/2021, regardless of when the returns are actually filed. The delinquent penalty will still apply.

What is Form 199? Form 199, California Exempt Organization Annual Information Return, is used by the following organizations to report the Receipts and Revenues, Expenses, and Disbursements. Organizations granted tax-exempt status by the FTB. Nonexempt charitable trusts, as described in IRC Section 4947(a)(1).

Form 199 is used by organizations that have been granted an exemption by the Franchise Tax Board (FTB), and operated under R&TC Section 23701, to provide the FTB with required annual information. If the answer to both of these questions is “No,” STOP HERE, DO NOT FILE THIS FORM. 2.
