Abatement is a statutory process for relieving taxpayers from the burden of property taxes, interest or collection fees when the law authorizes abatement and when the Board, in its discretion, agrees that the request is reasonable and proper. The Board is never required to grant a particular abatement.

To enroll in the Current Use program, landowners must submit an application to the Current Use Land Program within the Vermont Department of Taxes. Each application must include a map of the parcel. The state approves applications for eligible “agricultural land” or “forest land,” as specified in the statute.

Land Use Change Tax Calculation The Land Use Change Tax (LUCT) is imposed at a rate of 10% of the full fair market value of land that is developed. LUCT is also due when land is withdrawn from the Current Use Program and the owner removes the lien.

The policy behind Current Use taxation, the common name for the Use Value Appraisal policy, is that farmland and forests should not be taxed at the same rate as developed land. This policy creates a property tax based on the land's use value and not its market value.

In 1978, the Vermont legislature passed a law establishing the Use Value Appraisal of Agricultural, Forest, Conservation and Farm Buildings Property. Today, this program is known as "Current Use" and is administered by the Division of Property Valuation and Review within the Vermont Department of Taxes.

Owners who wish to withdraw all or a portion of land and/or buildings should file Form LV-314, Request For Withdrawal From The Use Value Appraisal Program by mail or online at myVTax. See the guide on how file Form LV-314 using myVTax.

At least 25 contiguous acres in active agricultural use; or smaller parcels which generate at least $2,000 annually from the sale of farm crops, or actively used agricultural land owned by or leased to a farmer. Taxed at use value.
