PHMSA is responsible for regulating and ensuring the safe and secure movement of hazardous materials to industry and consumers by all modes of transportation, including pipelines.

The maximum civil penalty for a single violation is now $209,002 for each day the violation continues, or $2,090,022 for a related series of violations of Federal pipeline safety laws.

Federal pipeline statutes provide for exclusive Federal authority to regulate interstate pipelines, interstate underground natural gas storage, and interstate LNG facilities.

FMCSA Hazardous Materials Safety Permits All companies that are required to have an FMCSA Safety Permit are required to have a PHMSA Registration. The fees to be assessed for natural gas transmission and hazardous liquid operators are as indicated below: Natural gas transmission pipelines: $392.20 per mile (based on 299,662 miles of pipeline). Hazardous liquid pipelines: $115.02 per mile (based on 227,327 miles of pipeline).

So, as a general rule, motor carriers that transport--and those who "offer" for transport--shipments of hazardous materials listed in 49 CFR 107.601, including "placardable quantities" of hazardous materials must register with PHMSA.

The fee is not prorated for registrations submitted after July 1. Since the 2000–2001 registration year, the amount of the annual registration fee is dependent upon the size and nature of the business. The fees for year 2023–2024 are $250 for small businesses and not-for-profit organizations, and $2,575 for all others.
