• This form allows the IHSS applicant/recipient or his/her legal representative to. choose an Authorized Representative for the IHSS program and identifies the functions the Authorized Representative may perform on his/her behalf. This form is only for the IHSS program.

Tier 1 crimes include but are not limited to: indecent exposure (Penal Code 314), misdemeanor child ography (Penal Code 311.11), misdemeanor oral copulation (Penal Code 288a), and misdemeanor sexual battery (Penal Code 243.4). Tier 2 requires registration as a sex offender for 20 years, or 10 years for minors.

Tier 1 crimes include: Specified abuse of a child (Penal Code (PC) section 273a(a); • Abuse of an elder or dependent adult (PC section 368); or • Fraud against a government health care or supportive services program.

Tier 1 offenses are specified abuse of a child, abuse of an elder or dependent adult and fraud against a government health care program or supportive services program. Tier 2 crimes also bar an individual from being an IHSS provider for 10 years, but the prospective provider can apply for a waiver.

A violation is the consequence of not following overtime and travel time limitations, and could cause you to be suspended from the program or terminated as an IHSS provider. It is important that you follow the overtime and travel time limitations to prevent getting a violation.

Beginning July 1, 2023, all IHSS and WPCS providers who do not live with their recipient are required to check-in and out at the beginning and end of each workday and indicate if services are being provided in the home or community.

Generally, misdemeanor crimes involving violence or threats of violence would disqualify a person from being an IHSS provider. Minor infractions, such as traffic violations, would not disqualify a person from being an IHSS provider.
