(a) Implied consent. --A person who drives a commercial motor vehicle in this Commonwealth is deemed to have given consent to take a test or tests of the person's breath, blood or urine for the purpose of determining the person's alcohol concentration or the presence of other controlled substances.

The DL-26 is a form that police and other law enforcement use to advise a person of their inability to refuse a chemical test under Section 1547 (Implied Consent) of the Pennsylvania Vehicle Code.

Refusal means automatically losing your license, plus any criminal DUI charges you may be facing. In addition to criminal penalties for a DUI conviction, you will lose your license for at least one year, under Pennsylvania's Implied Consent Law in PA Code § 1547.

While it is your right to refuse a breathalyzer test in California, doing so comes with its own set of consequences. These consequences include automatic license suspension, potential enhancement of penalties, and the potential impact on your legal defense.

Since a driver who refuses to complete a chemical test violates the implied consent arrangement, almost every state imposes a mandatory driver's license suspension on the driver.
