What is VESSA? The Illinois Victim's Economic Security and Safety Act, or VESSA, provides up to 12 weeks of unpaid leave to an employee who is a victim of or who has a family member who is a victim of domestic or sexual violence to address issues arising from domestic or sexual violence.

The Victims' Economic Security and Safety Act (VESSA) allows employees who are victims of domestic violence, sexual violence, gender violence, or any other crime of violence or who have family or household members who are victims of such violence to take up to twelve (12) weeks of unpaid leave per any twelve (12) month ...

A bank of FAQs were released in late May 2023, following the passage of the law in March of this year. The Illinois paid leave law requires private employers to provide up to 40 hours of paid leave in a 12-month period to their employees.

VESSA applies to all Illinois employers and requires them to provide unpaid leave to employees who are victims of domestic, sexual, or gender violence or crimes of violence (or whose family or household members are victims). Signed by Gov. J.B. Pritzker on July 28, the amendments took effect immediately.

An employee may take VESSA leave to: Obtain psychological or other counseling for the employee or the employee's family or household member. Participate in safety planning, including temporary or permanent relocation or other actions to increase the safety of the victim from future domestic or sexual violence.

The Family and Medical Leave Act (FMLA) lets you take time off work when you are sick. You must be an eligible employee with a serious health condition that prevents you from doing your job. You can also take time off if your parent, spouse, or child has a serious health condition.

If the leave is due to a serious health condition of the employee or the employee's spouse, Civil Union partner, parent, or child, the employee must also submit FMLA certification. VESSA leave is not leave time in addition to FMLA leave when the reason for VESSA leave also qualifies under FMLA.
