All persons who are mandated reporters are required, by law, to report all known or suspected cases of child abuse or neglect. It is not the job of the mandated reporter to determine whether the allegations are valid.

A list of persons whose profession qualifies them as “mandated reporters” of child abuse or neglect is found in California Penal Code Section 11165.7. The list is extensive and continues to grow. It includes all school/district employees, administrators, and athletic coaches.

Under CA law patients do not retain the right to refuse reporting. A mandated reporter is required to call the Police Department in the city where the incident occurred immediately or as soon as is practicable. Turn in a written report within 48 hours to the Police Department in the city where the incident occurred.

California defines this law under the Child Abuse and Neglect Reporting Act (CANRA). Mandated reporters include teachers, principals, social workers, doctors, nurses, healthcare workers, therapists, childcare providers, and police officers.

LEGISLATIVE COUNSEL'S DIGEST The act requires certain professionals, including specified health practitioners and social workers, known as mandated reporters, to report known or reasonably suspected child abuse or neglect to a local law enforcement agency or a county welfare or probation department, as specified.

Mandated reporters are required to report suspected abuse or neglect by phone as soon as possible and follow up with a completed written report (see link below for form) within two days.

For example, CA AB 1432 requires educators and school personnel to take mandated reporter training annually with proof of completion. Similarly, licensed child care providers in the state must take mandated reporter training within 90 days of employment, and every two years thereafter, as a condition of licensure.
